Terms of Service

1. ACCEPTANCE OF TERMS

By accessing and using the Charlie Kaine Photography client gallery ("Gallery"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use this Gallery.

2. COPYRIGHT AND OWNERSHIP

All photographs, images, and videos displayed in this Gallery are the exclusive property of Charlie Kaine Photography and are protected by United States and international copyright laws. Charlie Kaine Photography retains full copyright ownership of all images unless explicitly transferred in writing.

3. LICENSE AND PERMITTED USE

Subject to your compliance with these Terms, Charlie Kaine Photography grants you a limited, non-exclusive, non-transferable license to:

  • View and download images designated for your personal use

  • Share images via the Gallery's built-in sharing features for personal, non-commercial purposes

  • Print images for personal use only (unless commercial usage rights have been purchased separately)

4. PROHIBITED USES

You may NOT:

  • Remove, alter, or obscure any copyright notices, watermarks, or metadata from images

  • Reproduce, distribute, modify, or create derivative works from images without written permission

  • Use images for commercial purposes without purchasing appropriate usage rights

  • Resell, sublicense, or transfer images to third parties

  • Use images in a manner that is defamatory, obscene, or violates any law

  • Apply filters, edits, or alterations that misrepresent the original work

  • Use images in connection with adult content, illegal activities, or hate speech

5. USAGE RIGHTS AND LICENSING

Personal Use: Images may be used for personal purposes including social media sharing, personal websites, and family distribution.

Commercial Use: Any commercial use including but not limited to advertising, marketing materials, publications, or business purposes requires purchase of commercial usage rights. Contact studio@charliekaine.com for licensing inquiries.

6. IMAGE SELECTION AND DELIVERY

  • Gallery access periods are specified in your service agreement

  • Downloaded images are provided in specified resolution and format

  • Charlie Kaine Photography reserves the right to include images in professional portfolio and marketing materials unless explicitly prohibited in writing

  • Galleries may be archived after the access period expires; extended access may be available for an additional fee

7. PRINT PRODUCTS AND PURCHASES

  • All print products are fulfilled by Charlie Kaine Photography or authorized third-party vendors

  • Print product sales are final unless products arrive damaged or defective

  • Color variations may occur due to monitor calibration and printing processes

  • Claims for damaged or defective products must be made within 14 days of receipt

8. PAYMENT TERMS

  • All fees are due as specified in your service agreement

  • Digital downloads may be contingent on full payment

  • Credit card payments are processed securely through industry-standard payment processors

  • Refunds are subject to the refund policy in your service agreement

9. CLIENT RESPONSIBILITIES

You are responsible for:

  • Maintaining confidential access to your gallery password

  • Any downloads or purchases made using your account credentials

  • Backing up downloaded images; Charlie Kaine Photography is not responsible for lost downloads

  • Compliance with these Terms of Service

10. MODEL RELEASES AND PERMISSIONS

By appearing in photographs or authorizing others to appear, you grant Charlie Kaine Photography permission to use images for promotional and portfolio purposes unless a separate model release specifies otherwise.

11. PRIVACY AND DATA PROTECTION

Your use of this Gallery is also governed by our Privacy Policy. We collect and process personal information as described in our Privacy Policy.

12. LIMITATION OF LIABILITY

Charlie Kaine Photography shall not be liable for:

  • Indirect, incidental, special, or consequential damages

  • Loss of data, profits, or business opportunities

  • Damages exceeding the amount paid for services

  • Technical failures, including but not limited to internet connectivity issues, server downtime, or data corruption

13. INDEMNIFICATION

You agree to indemnify and hold harmless Charlie Kaine Photography from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of images.

14. MODIFICATIONS TO TERMS

Charlie Kaine Photography reserves the right to modify these Terms at any time. Continued use of the Gallery after changes constitutes acceptance of modified Terms.

15. TERMINATION

Charlie Kaine Photography may terminate or suspend your access to the Gallery at any time for violation of these Terms.

16. GOVERNING LAW

These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of Los Angeles County, California.

17. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full effect.

18. ENTIRE AGREEMENT

These Terms, together with your service agreement and our Privacy Policy, constitute the entire agreement between you and Charlie Kaine Photography.
